Bullying matter occurring in an Education Department school or childcare centre
This area of law relates to situations where a child experiences bullying, harassment, or unsafe treatment in a school or childcare setting. It can involve seeking accountability from the school or education department, ensuring proper duty of care is upheld, and taking steps to protect the child’s wellbeing and educational environment.Please note the following (please be advised this information is of a general nature and is not legal advice):
- First, speak with your child’s teacher or room leader to see if the matter can be resolved.
- If you are dissatisfied with the actions taken, contact the school to arrange a meeting with the principal or centre manager. Keep a record of what was discussed during this meeting.
- Ask your child’s school for a copy of the schools Behaviour Support and Management Plan as well as any additional information they have on bullying.
- If you are still dissatisfied with the action taken, you can lodge a complaint through your states Department of Education online complaint form. Links below for your convenience.

The Education Department has a duty of care to all students and are required to have anti-bullying plans in place. If you are unable to get the information you require from the above, you could contact The Law Society in your state to find a specialist law firm that can help you.
